📄 General Information

As of August 29, 2019, Alabama law (Act 2019-340) changed the marriage process. You no longer apply for a license instead, couples must complete and notarize a Marriage Certificate form and submit it for recording.

✅ Steps to Get Married in Alabama:

  1. Visit the Alabama Vital Statistics website  to complete the Marriage Certificate form.

  2. Ensure all names match your current legal identification.

  3. Print the form single-sided (do not print on the back).

  4. Both parties must sign in front of an Alabama notary.
    ➤ Signature dates must match.

  5. Do not make any alterations to the form (no white-out, strikethroughs, or corrections).

  6. Return the original notarized form to the Montgomery County Probate Office:

    • In person: See office address above

    • By mail: See mailing instructions below

Your marriage becomes legal when the completed form is properly recorded by the Probate Court.
📅 Your wedding date will be the date of the last notary signature.


💳 Payment Information

  • Filing fee: $78.50 (includes 1 certified copy)

  • Additional copies: $2.00 each

  • Accepted Payment Methods:

    • In-person: Cash, or credit/debit card

    • By mail: Money order

  • Not accepted: checks, prepaid cards, CashApp, PayPal, Venmo, ApplePay

💡 All payments must include a copy of the account holder’s ID (Driver’s License or State ID), matching the name on the check or card.

 

 


 

    📬 Filing by Mail

    To file your completed Marriage Certificate Affidavit by mail, include:

    • The original notarized certificate

    • A copy of your driver’s license

    • A letter with your:

      • Full mailing address

      • Contact phone number

    • A money order for $78.50 (includes one certified copy)
      ➕ Add $2.00 for each additional certified copy

    💒 Courthouse Ceremonies

    Important Update

    As of August 29, 2019, Alabama law no longer requires marriage ceremonies. However, if you wish to have a courthouse ceremony, Montgomery County offers them by appointment only.

    Ceremony Details

    • Days & Times: Monday, Wednesday, and Friday afternoons between 12:00 p.m. – 4:00 p.m.

    • Location: Small multi-purpose room, 2nd Floor, Courthouse Annex III

    • Restrictions: No music or decorations allowed. Please be discreet as this is a workplace environment.

    Call (334) 832-1235 to schedule your ceremony.

    ⏰ Important Notice

    Please arrive on time for your appointment. If you are more than 15 minutes late, you may need to reschedule.

    📞 Appointment Confirmation

    Please confirm your appointment prior to your ceremony date. Failure to confirm may result in your ceremony not being performed.


    What to Bring

    • Valid Driver’s License, state-issued non-driver ID, or passport (with Visa attachment if applicable).

    • Your identification must match the name on your paperwork exactly.

    • Witnesses are not required, but you may bring up to 8 guests.


    Fees

    • Total fee: $88.00 (includes ceremony, paperwork, and one certified copy of your marriage record).

    • Additional certified copies: $2.00 each.

    • Payment Breakdown:

      • $2.00 in cash (exact change required)

      • Remaining balance can be paid by cash, money order, or credit/debit card.

    • Note: Bills larger than $50 cannot be accepted.


    Requirements for Persons 16 or 17 Years of Age

    Persons aged 16 or 17 must complete two separate, fillable forms fully and correctly, with no alterations:

    • Marriage Certificate Affidavit

    • Affidavit of Consent for Marriage of Minors

    Important Instructions:

    • Both affidavits must be printed single-sided (nothing printed on the back).

    • Signatures must be notarized prior to submission.

    • You must sign in front of the notary, and the date you sign must match the notary’s signature date.

    • The consent form must be signed and notarized at the same time as the minor’s signature on the Marriage Certificate Affidavit.

    Filing Instructions:

    • After notarization, submit the original affidavits to the Montgomery County Probate Office for recording.

    • You have 30 calendar days from the notarized date to record the documents.

    Fees:

    • Filing fee: $81.00 (includes one certified copy).

    • Additional certified copies: $4.00 each.

    • Payment Methods: In-Person: Cash or Credit/Debit Card  By Mail: Money Order  NO CHECKS, CASHAPP, PAYPAL, VENMO, APPLEPAY

     

    🆔 Requirements for Persons 18 Years or Older

    All applicants must provide positive identification showing their correct legal name.

    Acceptable Forms of Identification

    • Valid driver’s license

    • State-issued non-driver identification

    • Passport with visa attachment

    ⚠️ The name on your ID must exactly match the name on your marriage certificate.
    The Montgomery County Probate Office does not collect or verify Social Security numbers.


    Important Policies

    • The Montgomery County Probate Office does not collect or require social security numbers for marriage license issuance.

    • The office does not discriminate based on immigration status and does not require proof of lawful presence or legal immigration status to issue a marriage license.


     

    📑 Requesting Copies of Marriage Records

    For Marriages Filed On or Before August 29, 2019

    Couples who filed their marriage record in Montgomery County on or before August 29, 2019, may request copies of their Marriage License or Marriage Certificate:

    • In Person:
      Bring your current Driver’s License or Non-Driver ID.
      Fee: $2.00 per certified copy.

    • By Mail:
      Send a letter including:

      • Your full name

      • Your spouse’s full name

      • Your mailing address and phone number

      • A copy of your current Driver’s License or Non-Driver ID

      • A money order for $2.00 per certified copy requested
